These terms apply to the PigiaFundi website, client portal, quote and inspection workflows, communications, and related support channels.
This draft is framed for Kenyan consumer and privacy rules.
It is drafted with Article 31 and Article 46 of the Constitution of Kenya, the Data Protection Act, 2019, the Consumer Protection Act, 2012, and the Kenya Information and Communications (Consumer Protection) Regulations in mind.
These terms govern the public PigiaFundi service in Kenya.
They apply when you browse the website, request an OTP, create or use an account, submit a job, review a quote, pay a deposit, use support channels, or otherwise use PigiaFundi.
By using the service, you agree to these terms and to the public Privacy Policy.
Nothing in these terms is intended to limit any rights that cannot lawfully be excluded under the Constitution of Kenya, the Consumer Protection Act, 2012, the Data Protection Act, 2019, or any other mandatory Kenyan law.
You are responsible for the accuracy and security of your access details.
PigiaFundi currently uses phone or email based sign-in with one-time passwords for client access.
You must provide accurate and current contact details and any job information you submit must be truthful and lawful.
You must keep your OTPs, login links, and account access private and must not share them with unauthorized persons.
If you believe your account, device, phone number, or email has been used without authority, you should contact PigiaFundi immediately.
PigiaFundi may suspend, restrict, or terminate access where there is fraud, impersonation, unlawful use, abuse of the platform, or a material breach of these terms.
Job records, inspections, and quotes depend on the information available at the time.
PigiaFundi coordinates requests, inspections, updates, and quote approvals so the work stays in one readable record.
When you submit a request, you should provide enough detail for the job to be understood, including location, notes, and photos where needed.
Inspection findings, job notes, and recommendations are based on the information available during review and may change if more work, hidden defects, or safety issues are discovered later.
A quote is valid only for the amount, scope, and period shown on the platform and may lapse, be revised, or be withdrawn if the underlying scope changes or approval is not given in time.
Unless PigiaFundi expressly states otherwise in writing, inspection notes and repair records are operational service records and not a structural, engineering, insurance, valuation, or legal certification.
Dates, response windows, and completion estimates are targets and not guarantees, especially where access, approvals, weather, utilities, safety issues, or third-party dependencies delay the work.
Quotes and deposits must follow the amount and process shown on the platform.
PigiaFundi records quote amounts and deposit requirements in Kenya Shillings and may use third-party payment partners to collect or verify payment.
All fees, deposits, and balances are payable in Kenyan Shillings unless PigiaFundi clearly states otherwise.
Where a deposit is required, work that depends on that deposit may wait until the payment is confirmed by PigiaFundi or its payment provider.
PigiaFundi may receive and store limited payment information such as a payment reference, authorization result, status, amount, and payer contact details needed for reconciliation and audit.
Full card, bank instrument, or wallet credentials are ordinarily handled by the relevant payment provider and not stored by PigiaFundi except where a limited masked or reference record is returned to us.
Refunds, reversals, or reasonable deductions for costs already incurred will be handled according to the job status, the work already done, the payment provider process, and any non-excludable Kenyan legal rights.
The platform must be used lawfully, fairly, and in a way that does not harm others.
You may not use PigiaFundi in a manner that creates legal, security, operational, or reputational harm.
You must not upload or submit unlawful, false, defamatory, abusive, discriminatory, infringing, malicious, or misleading material.
You must not interfere with the website or APIs, attempt to bypass authentication, scrape the service at scale, reverse engineer restricted parts of the platform, or introduce malware or harmful code.
You must not impersonate another person, use another person’s OTP or account, or submit photos, phone numbers, email addresses, or property details that you do not have authority to use.
PigiaFundi is not an emergency dispatch service. If there is a fire, gas leak, electrocution risk, threat to life, or other emergency, you should contact the relevant emergency or utility service first.
Service availability may change and some cancellations may carry reasonable cost consequences.
PigiaFundi may improve, suspend, or modify parts of the service from time to time.
PigiaFundi may change features, workflows, or service categories where reasonably necessary for security, compliance, safety, or service improvement.
You may request a cancellation or reschedule, but where a site visit has occurred, materials have been bought, labour has been reserved, or costs have already been incurred, PigiaFundi may charge or recover reasonable costs to the extent permitted by Kenyan law.
PigiaFundi may delay, refuse, or stop a job where there is a safety concern, non-payment, missing approval, abusive conduct, lack of access, or a lawful instruction from an authority.
The PigiaFundi brand, software, and website content remain protected.
PigiaFundi or its licensors retain all rights in the platform, brand assets, page design, workflow logic, and non-user content.
You may use the public website and your account for your own lawful service purposes only.
You may not copy, re-sell, re-package, or commercially exploit the PigiaFundi software, design, brand, or content without written permission.
You retain rights in photos, notes, and other materials you submit, but you grant PigiaFundi a non-exclusive licence to host, store, display, reproduce, and use that material as needed to deliver, document, support, secure, and improve the requested service.
PigiaFundi will use reasonable care, but the service cannot promise perfection or uninterrupted availability.
The public platform is provided on an “as available” basis to the fullest extent allowed by law.
PigiaFundi does not warrant that the service will be uninterrupted, error-free, or suitable for every purpose in every circumstance.
To the fullest extent permitted by Kenyan law, PigiaFundi will not be liable for indirect, incidental, special, or consequential loss arising from use of the platform, delays, third-party outages, or inaccurate information supplied by users or third parties.
Nothing in these terms excludes liability that cannot lawfully be excluded under Kenyan law, including liability arising from fraud, wilful misconduct, or any other mandatory legal rule.
These terms are governed by the laws of Kenya.
PigiaFundi aims to resolve issues quickly and fairly before they escalate.
If you have a complaint, you should first contact PigiaFundi at info@pigiafundi.com with enough detail for us to investigate and respond.
The parties should attempt a good-faith resolution before starting formal proceedings, and they may agree to mediation or another lawful dispute resolution process.
Unless Kenyan law requires a different forum, unresolved disputes relating to these terms or the service will be determined under the laws of Kenya and may be brought before the competent courts of Kenya.
Use these channels for legal, service, or account questions.
